Common questions
Questions clients ask about wills, probate & estate administration
Do I need a will?
Without a will, your estate is distributed under the applicable intestacy rules rather than your wishes. A will records your intentions and reduces dispute and delay.
What makes a will valid in Nigeria?
Testamentary capacity, writing, signature by the maker in the presence of two witnesses who attest, and voluntariness. A beneficiary should not act as a witness.
What is probate?
The court grant that confirms an executor's authority to administer a testate estate. Where there is no will, beneficiaries apply for letters of administration.
Can family members dispute a will?
Disputes can arise over validity, capacity or customary claims. Early, clear documentation and professional drafting reduce the risk.
These answers provide general information only and are not legal advice. Outcomes depend on the facts, evidence and applicable law of each matter.
