Common questions
Questions clients ask about family & matrimonial law
How is divorce obtained in Nigeria?
Statutory marriages are dissolved by a court under the Matrimonial Causes Act on established grounds. Customary marriages are dissolved through the processes that govern them. A lawyer can advise which framework applies to your marriage.
Who gets custody of the children?
Nigerian courts decide custody on the welfare and best interests of the child, not automatically in favour of either parent. Evidence of day-to-day care, stability and commitment matters.
How is property handled after divorce?
Courts consider the circumstances of each case, including contributions to the family and property. There is no automatic equal division; outcomes depend on the evidence.
Can the other parent be denied access to the children?
Access is normally maintained unless the child's welfare requires otherwise. Courts can define access by schedule or order supervised access in appropriate cases.
These answers provide general information only and are not legal advice. Outcomes depend on the facts, evidence and applicable law of each matter.
