Common questions
Questions clients ask about child custody & welfare
Who can apply for custody?
Parents may apply for custody. In appropriate cases, other persons caring for a child may apply, and the court considers the child's welfare above all other considerations.
Can custody be shared between parents?
Yes. Courts can make joint custody arrangements where the parents can realistically cooperate, or define how decisions are to be made.
Can a parent relocate with the child?
Relocation within or outside Nigeria can affect the other parent's access and may require consent or a court order. Relocation disputes are treated on the child's welfare.
What about maintenance for the child?
A court may order contributions to upkeep, school fees and medical expenses. Maintenance obligations are separate from custody and access decisions.
