Common questions
Questions clients ask about land & property law
How do I verify land before buying it?
A lands registry search, confirmation of the survey plan and charting, physical inspection, and written family or community consent where applicable. Never rely on receipts or possession alone.
What is Governor's consent?
Under the Land Use Act, transfers of rights of occupancy generally require the Governor's consent. A transfer without the required consent may be defective, so consent should be confirmed before completing a purchase.
What documents should a buyer receive?
A properly executed deed of assignment, the survey plan, registered title documents and receipts. A lawyer should review and document the transaction before payment is made.
Someone is occupying my land unlawfully. What can I do?
Document the occupation, send a formal demand, and where necessary apply for an injunction or order for ejectment. Avoid self-help such as forceful eviction, which exposes you to counterclaims.
