Common questions
Questions clients ask about criminal defence & police matters
Can the police arrest without a warrant?
Arrest without a warrant is lawful in defined circumstances, but the person arrested must be informed of the grounds. An arrest is not a determination of guilt.
How long can the police detain a person?
The Constitution sets fixed limits, and detention beyond those limits without an order of court is unlawful. A lawyer can apply for police bail or compel production before a court.
Am I obliged to make a statement at the police station?
A person is not compelled to answer questions or make a statement. You are entitled to legal representation and to have a family member informed.
What is bail?
Bail is conditional release from custody, granted at the police station for bailable matters or by the court. Conditions must be reasonable and the process is documented.
These answers provide general information only and are not legal advice. Outcomes depend on the facts, evidence and applicable law of each matter.
