Common questions

Questions clients ask about intellectual property

Do I need to register a trademark?

Registration provides the strongest protection in Nigeria, and the registry operates on a first-to-file basis. Early application prevents others registering your brand.

How long does trademark protection last?

An initial registration period, renewable on payment of the prescribed fees for further periods, provided use and renewals are maintained.

What is passing off?

Misrepresenting goods, services or business as those of another, causing damage. It protects unregistered goodwill.

Is copyright automatic?

Copyright arises on creation of an eligible work. Registration is not a precondition but provides useful evidence of ownership and date.

These answers provide general information only and are not legal advice. Outcomes depend on the facts, evidence and applicable law of each matter.
